Combat immunity

This is interesting – can ‘combat immunity’, i.e. the non-liability granted to soldiers in battle situations, extend to decisions made before the fight, here procurement of faulty weapons? Considering the recent claims against the German Ministry of Defence for purchasing defective rifles, which lead to several deaths of German soldies in Afghanistan, this case sounds very familiar and could become an interesting precedent.
