Mutual trust and confidence in Australia – again

I have blogged about it before and predicted that mutual trust and confidence will become an integral part of Australian employment contract law as it is in New Zealand.

The Full Court of the Federal Court of Australia has now confirmed in Commonwealth Bank of Australia v Barker [2013] FCAFC 83 that the principle of trust and confidens is an implied term in every employment agreement.

So there you go. Australia has finally caught up with NZ.
